Terms of use

These terms are Rail’s end user license agreement (EULA). By downloading or using the app you accept them, so please read them; we have written them to be understood.

Who provides Rail

Rail is developed and published by Juan Salguero Ibarrola, tax ID (NIF) 26262302M, with address at Calle Juan Díaz del Moral, 34, 29629 Torremolinos (Málaga), España, under the trade name Jade Horizon Studio. In these terms, “we” means him and “you” means the person using the app.

You can send any questions, complaints or claims about the app or these terms to hello@jadehorizonstudio.com or by post to the address above. For help with the app, write to support@jadehorizonstudio.com.

An agreement with you, not with Apple

This agreement is concluded between you and us only, and not with Apple Inc. or its subsidiaries (“Apple”). We alone are responsible for Rail and its content. These terms do not set usage rules that conflict with the Apple Media Services Terms and Conditions (the App Store terms); if any did, Apple’s terms would prevail.

License

We grant you a personal, non-exclusive, non-transferable license to use Rail, for non-commercial purposes, on any Apple-branded product that you own or control and on which the app is available (currently iPhone), as permitted by the Usage Rules of the App Store terms. Other accounts associated with yours via Family Sharing or volume purchasing may also use it.

The license does not transfer ownership of the app or its content to you.

What you may not do

Except where the law expressly allows it, you may not:

  • copy, modify, distribute, sell, rent or sublicense the app;
  • decompile it, reverse engineer it or attempt to obtain its source code, except in the cases allowed by Article 100 of the Spanish Intellectual Property Act;
  • use our server outside the app, send it bulk automated requests, register fake identifiers, try to overload it or access non-public parts of it;
  • circumvent the measures that protect purchases or Rail Plus features;
  • use Rail for unlawful purposes or in a way that harms other people or the service.

Rail Plus

  • One-time purchase. Rail Plus is an in-app purchase that you pay for once: it is not a subscription and does not renew. It unlocks additional features, such as the widget and alert notifications, which the app describes before you buy.
  • Payment through Apple. The purchase is made on the App Store, at the price, in the currency and with the taxes it shows you before you confirm. We don’t receive or store your payment details.
  • Family Sharing. If you use Family Sharing, the members of your family group can use Rail Plus without buying it again.
  • Restore Purchases. If you change iPhone or reinstall the app, tap “Restore Purchases” to get Rail Plus back with the same Apple Account, without paying again.
  • Refunds and withdrawal. Refunds, and the right of withdrawal where it applies, are handled through Apple under its terms. You can request them at reportaproblem.apple.com; we cannot issue refunds directly.

Timetables and alerts are for guidance

Rail shows timetables, stations and live trains based on the open data Renfe publishes at data.renfe.com, reused under its terms, and the notices Renfe issues on its official channels, which are interpreted and translated automatically.

  • Timetables may change or contain errors, and the copy stored on your iPhone may be out of date if you have been offline for a while.
  • Automatic translations may be inaccurate; Renfe’s original text is the one that counts.
  • Notifications may be delayed or not arrive: they depend on Renfe, on Apple, on your connection and on your settings.

Rail is an information tool. If your journey matters, check it on Renfe’s official channels. Tickets, complaints and incidents during your journey are matters for Renfe.

Rail is not a Renfe app

Rail is an independent app. It is not affiliated with Renfe Operadora, nor sponsored or endorsed by it. Renfe and Cercanías are trademarks of their respective owners, and we mention them only to identify the service the data refers to. Renfe accepts no responsibility for the use Rail makes of its data.

Updates and availability

We work to keep Rail working well, but we cannot guarantee that it will always be available or free of errors. We may update the app to fix bugs, adapt it to changes by Renfe or in iOS, or improve it, and some features that depend on the server may require the latest version.

If a change significantly impairs a Rail Plus feature you have paid for, you will have the rights consumer law gives you, including, where applicable, terminating the contract with a refund.

Maintenance and support

We alone are responsible for providing the maintenance and support for Rail specified in these terms or required under applicable law. You can ask for help at support@jadehorizonstudio.com or on the support page. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.

Warranty

If you are a consumer, you have the statutory conformity guarantees for digital content and services set out in the consolidated text of the Spanish General Law for the Defence of Consumers and Users (TRLGDCU) or, where applicable, in the law of your country. These terms do not limit them.

We alone are responsible for any warranties for the app, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price you paid for it. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

Beyond those statutory guarantees, and to the extent the law allows, the app is provided as is, without any guarantee that the information is accurate, complete or up to date.

Liability

We are liable for the damage we cause by breaching these terms, in accordance with the law. To the extent the law allows, we are not liable for:

  • damage arising from errors, delays or changes in Renfe’s data or notices, such as missing a train or a connection;
  • interruptions or failures of services outside our control, such as Apple’s, your mobile operator’s or the internet;
  • indirect damage that was not foreseeable when you accepted these terms.

Nothing in these terms limits our liability for intent or gross negligence, for death or personal injury, or any right you have as a consumer under rules that cannot be excluded by contract.

Claims about the app

We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of it, including, but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.

Intellectual property

The app, its code, design, texts and illustrations, and the Rail name and logo belong to Juan Salguero Ibarrola or his licensors and are protected by intellectual and industrial property law. Renfe’s data belongs to Renfe and is reused under its terms. These terms give you no rights over any of this beyond the license to use the app.

In the event of any third-party claim that the app or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of that claim.

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You also agree to use Rail in accordance with applicable law.

Third-party terms

When using Rail you must comply with any third-party terms that apply to you, such as your agreement with your mobile operator or your data plan, and Apple’s terms for the App Store, Maps, notifications and Family Sharing. Rail uses mobile data to download timetables and alerts; what that costs depends on your plan.

Apple as third-party beneficiary

Apple and its subsidiaries are third-party beneficiaries of these terms. Upon your acceptance of them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

Privacy

How we process data is explained in the privacy policy.

Term and termination

These terms apply for as long as you use Rail. You can end them at any time by deleting the app. We may terminate your license if you seriously breach these terms, for example by abusing the server. On termination you must stop using the app; the clauses that by their nature should survive, such as those on liability and governing law, will continue to apply.

Changes to these terms

We may change these terms for valid reasons, such as changes to the app, to the law or to third-party services. We will publish the new version on this page with its date. If a change significantly affects you to your detriment, we will tell you reasonably in advance in the app or on this website, and you may stop using the app before it takes effect.

Governing law and courts

These terms are governed by Spanish law. If you are a consumer, you keep the protection given to you by the mandatory rules of the European Union country where you live, and you may bring claims before the courts of your place of residence.

Before going to court, write to us at hello@jadehorizonstudio.com and we will try to resolve the matter amicably. You can also contact consumer information offices and consumer associations.

Final provisions

If any clause is held invalid, the rest remains in force. Our not exercising a right does not mean we waive it. These terms, together with the App Store terms, are the entire agreement between you and us regarding Rail. They are published in several languages: the original version is the Spanish one and, if a translation differs, the version more favorable to you as a consumer will apply.
